Somo Enterprises, Inc ("PhoneBook") provides this Privacy Policy to inform users of our policies and procedures regarding the collection, use, and disclosure of personally identifiable information received from users of somoenterprises.com. This Privacy Policy may be updated from time to time for any reason; each version will apply to information collected while it was in place. We will notify you of any material changes to our Privacy Policy by posting the new Privacy Policy on our Site and placing a prominent notice on our home page. You are advised to consult this Privacy Policy regularly for any changes. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Service

PhoneBook is a Participant in the TRUSTe Privacy Seal Program. TRUSTe is an independent organization whose mission is to advance privacy and trust in the networked world. As this Web site wants to demonstrate its commitment to your privacy, it has agreed to disclose its information practices and have its privacy practices monitored for compliance by TRUSTe.

Information Collection and Use

Our primary goals in collecting personally identifiable information are to provide you with the products and services made available through PhoneBook, to communicate with you, and to manage your registered user account, if you have one.

Personally Identifiable Information

When you become a registered user, we will ask you for certain personally identifiable information. This refers to information about you that can be used to contact or identify you ("PII or Personal Information"). Personal Information may include, but is not limited to, your name, phone number, email address, certain information related to your mobile account, and home or business postal addresses, and if applicable, payment information. You may also submit additional Personal Information in the course of using PhoneBook that you may choose to add in your profile.

Non-Identifying Information

We also collect other information that you provide at registration and in the course of using PhoneBook that cannot be used to identify you (including, for example, but not limited to, your zip code, gender, time zone, wireless carrier, handset type, or viewing preferences) ("Non-Identifying Information"). Some Non-Identifying Information would be considered a part of your Personal Information if it were combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be identified. However, the same information remains Non-Identifying Information when it is taken alone or combined only with other non-identifying information.

We use your Personal Information (in some cases, in conjunction with your Non-Identifying Information) mainly to provide PhoneBook, complete your transactions, and administer your inquiries. We may aggregate your information with information collected from other PhoneBook users in order to understand how PhoneBook is used, and to improve the quality and value of PhoneBook.

We may share aggregated information derived from your Personal Information, Non-Identifying Information and Log Data with third parties for industry analysis and demographic profiling and to deliver targeted advertising about other products and services. We may also use your information without aggregating it to serve you personally with your consent (for example, to deliver a product to you according to your individual preferences).

Information Sharing and Disclosure

PhoneBook Users We provide an exciting way to communicate with your network of friends and contacts (your "Network"). At your request, PhoneBook will collect your call logs, SMS (as defined below) records and certain other information pertaining to your mobile account, including but not limited to information about your geographic region, mobile plan and handset, (your "Mobile Information") from your mobile service provider ("Mobile Service Provider") and display it to you and other PhoneBook users. Among the tools that we offer, PhoneBook allows you to annotate your Mobile Information by inserting the names, addresses, birthdays, pictures and other details ("Contact Information") of the persons corresponding to the telephone numbers listed in your Mobile Information. This is called "Backing Up" your phone numbers.

To be able to access your Mobile Information, PhoneBook may require login information to access your wireless account (your "Login Information"). Login Information will be used by PhoneBook exclusively for obtaining your Mobile Information. By providing your Login Information to PhoneBook, you represent and warrant that you have the authority to permit us to use your Login Information on your behalf and you hereby authorize and appoint us as your agent to use your Login Information to obtain your Mobile Information.

You can choose what other Personal Information you provide as part of your profile ("Profile Information") and in some cases you can choose whether to share Profile Information publicly through PhoneBook by making selections via the "user settings", "privacy" section of your profile webpage. The default setting is to "Allow" so others can see your friends and mutually called numbers. We will display your Personal Information in your profile page and elsewhere through PhoneBook according to the preferences you set in your account. Any information you choose to provide should reflect how much you want other PhoneBook users to know about you. We recommend that you guard your anonymity and sensitive information and we encourage users to think carefully about what information about themselves they disclose in their profile pages. You can review and revise your Profile Information at any time by going to "Edit Settings", "Privacy". When PhoneBook identifies that you have been in contact with another PhoneBook user (a "Friend") via your "Mobile Information," we will share your Profile Information, including your mutually called numbers and certain statistics, with that Friend. If you are not a PhoneBook member and you learn your phone number has been posted on our site, you have the opportunity to have your phone number listing removed by contacting us at privacy@somoenterprises.com.

If you set your settings to share mutual friends on this Web site, you should be aware that any personally identifiable information you submit there can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit in these forums.

Invite a Friend If you choose to use our invitation service to tell a friend about our site, we will ask you for information needed to send the invitation such as your friend's cell phone number. We will send your friend an SMS text message in your name inviting him or her to visit the site and one reminder via SMS. PhoneBook stores this information to send this invite and one time reminder. PhoneBook will not allow a user to send more than three invites to the same person over a five year period.

Service Providers and Business Partners We engage certain trusted third parties to perform functions and provide services to us, including, without limitation, hosting and maintenance, customer relationship, database storage and management communication services through SMS, and direct marketing campaigns. These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

The Company does supplement the data it collects with additional data received from third party sources, such as with data from Mobile Service Providers.

We may also provide Personal Information to our business partners or other trusted entities for the purpose of providing you with information on goods or services we believe will be of interest to you unless you opt out at the time of registration. You can, at any time, opt out of receiving such communications.

Compliance with Laws and Law Enforcement We cooperate with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims or legal process (including subpoenas); to protect the property and rights of PhoneBook or a third party; to protect the safety of the public or any person; to prevent or stop any illegal, unethical, or legally actionable activity; or to comply with the law.

Business Transfers We may sell, transfer or otherwise share some or all of our assets, including your personally identifiable information, in connection with a merger, acquisition, reorganization or sale of assets, or in the event of bankruptcy. We will notify you before transferring your information to a new entity as part of a merger, acquisition, reorganization or sale of some or all of our assets if the new entity's processing of your information will materially differ from that set forth in this Privacy Policy.

Communicating Via a PhoneBook Account

As part of PhoneBook, our users may communicate with each other as well as with non-registered users through use of their accounts. The email or SMS messages users create on PhoneBook will be sent from PhoneBook on their behalf. Contact information for non-registered users will be stored on PhoneBook in a user's account and will only be visible to those users who have also been in contact, as indicated by their Mobile Information, with the same non-registered users.

We may provide the means through which you can receive messages on your phone or wireless device via short message service ("SMS Service") or wireless internet ("WAP Services"). We may also make available content and versions of PhoneBook available via WAP and mobile phone service. If you subscribe to one of our SMS, WAP or mobile services, you thereby agree to receive such service at the address you provide for such purposes. Such messages may come from us, or from third parties who we believe may have goods or services of interest to you (unless you have elected not to receive such messages at the time you subscribe).

You understand that your Mobile Service Provider's standard rates may apply to these messages, and that you may opt-out of receiving them by notifying us at unsubscribe@somoenterprises.com. You may also opt-out of receiving text messages from PhoneBook at any time by replying STOPALL to any text message that PhoneBook sends you. You represent that you are the owner or authorized user of the wireless device you use to sign up for PhoneBook, and that you are authorized to approve the applicable charges.

Changing or Deleting Information

If you are a registered PhoneBook user, or your information has been provided by a PhoneBook user, you may review, update, correct, or delete the Personal Information in Your Profile by logging into your account, your settings, and updating your account, or emailing us at privacy@somoenterprises.com. If you completely delete all such information, then your account may become deactivated. If you would like us to delete your record in our system, please contact us and we will attempt to accommodate your request if we do not have any legal obligation to retain the record.

If you are not a PhoneBook user, you may email us at privacy@somoenterprises.com to request a "global unsubscribe," which will ensure that your phone number or other Personal Information associated with your phone number is not included anywhere on our site.

Log Data

When you visit the PhoneBook site, our servers automatically record information that your browser sends whenever you visit a website ("Log Data"). This Log Data may include information such as your IP address, your browser type, the domain from which you are visiting, the web pages you visit, the search terms you use, and any advertisements on which you click. For most users accessing the Internet from an Internet service provider, the IP address will be different every time you log on. We use Log Data to monitor the use of PhoneBook, and for the technical administration of the PhoneBook site.

We use a third-party tracking service that uses cookies to track non-personally identifiable information about visitors to our site in the aggregate to track usage and volume statistics to improve our Web site.

Cookies

Like many websites, we also use "cookie" technology to collect additional website usage data and to improve PhoneBook. A cookie is a small data file that we transfer to your computer's hard disk. We do not use cookies to collect personally identifiable information. We may use both session cookies and persistent cookies to better understand how you interact with the PhoneBook, to monitor aggregate usage by our users and web traffic routing on the PhoneBook site, and to improve PhoneBook. A session cookie enables certain features of the PhoneBook site and is deleted from your computer when you disconnect from or leave. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the PhoneBook site. Persistent cookies can be removed by following your web browser help file directions. Most Internet browsers automatically accept cookies. You can instruct your browser, by editing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit.

Some of our business partners (e.g., tracking services) use cookies on our site. We have no access to or control over these cookies.

This privacy statement covers the use of cookies by PhoneBook only and does not cover the use of cookies by any of these tracking services.

Security

We are very concerned about safeguarding the confidentiality of your personally identifiable information. We employ industry standard administrative, physical, and electronic measures designed to protect your information from unauthorized access.

When you enter your phone number, carrier and password during registration or when updating, we encrypt that information using secure socket layer technology (SSL).

We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored personal data to you via email or conspicuous posting on the PhoneBook site in the most expedient time possible and without unreasonable delay, consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

Phishing

Identity theft and the practice currently known as "phishing" are of great concern to PhoneBook. Safeguarding information to help protect you from identity theft is a top priority. We do not and will not, at any time, request your credit card information, your account ID, login password, or national identification numbers in a non-secure or unsolicited e-mail or telephone communication. Links to Other Websites

PhoneBook, as well as communications from us or from other PhoneBook users, may contain links to other websites. The fact that we link to a website is not an endorsement, authorization, or representation of our affiliation with that third party. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data, or solicit personally identifiable information from you. Other sites follow different rules regarding the use or disclosure of the personally identifiable information you submit to them. We encourage you to read the privacy policies or statements of the other websites you visit.

Our Policy Towards Children

PhoneBook is not directed to children. If a parent or guardian becomes aware that his or her child has provided us with personally identifiable information without their consent, he or she should contact us at privacy@somoenterprises.com. We do not knowingly collect personally identifiable information from children under 13. If we become aware that a child under 13 has provided us with personally identifiable Information, we will delete such information from our files.
